These Terms & Conditions ("Terms") apply to your use of www.njhousesforcash.com (the "Site"), operated by NJ Houses for Cash ("we," "us" or "our"). By using the Site or submitting a request for an offer, you agree to these Terms. If you don't agree, please don't use the Site.

Please read the Arbitration and class-action waiver section. It requires most disputes between you and us to be resolved by binding arbitration on an individual basis, and you give up the right to a jury trial or to take part in a class action, unless you opt out as explained there.

About our services

NJ Houses for Cash buys residential real estate directly from property owners in New Jersey. We are not a real estate brokerage, and we do not act as your agent or represent you in any transaction. You are free to consult a real estate agent, attorney, accountant or other advisor before deciding whether to sell to us.

Offers are not binding

Any offer, estimate or price we discuss is non-binding and may change after we review the property, its title and other details. Neither you nor we are obligated to complete a sale until both parties sign a written purchase agreement, and that agreement will control the terms of any sale.

Your information

You agree that the information you give us is accurate and that you have the right to share it, including the property details and the phone number and email you provide. Our Privacy Policy explains how we collect, use and protect your information.

Communications

If you tick the consent box on our form, you agree that we may contact you about your property by phone call, text message and email at the contact details you provided, including by automated means. Consent is not a condition of any purchase or sale. Message frequency varies, and message and data rates may apply. Reply STOP to any text to opt out, or HELP for help. You can also ask us to stop contacting you at any time using the contact details below.

Acceptable use

You agree not to submit false or misleading information, submit information about a property you have no right to sell or discuss, interfere with the Site's operation or security, try to gain unauthorized access to our systems, or use the Site for any unlawful purpose.

Intellectual property

The Site and its content, including text, graphics, logos and design, are owned by NJ Houses for Cash or its licensors. You may not copy, reproduce or distribute them without our written permission, except for your own personal, non-commercial use.

Disclaimer

The Site and its content are provided "as is" for general information only, without warranties of any kind, express or implied. Nothing on the Site is legal, tax or financial advice. We do not guarantee that the Site will be available, error-free or free of harmful components.

Limitation of liability

To the fullest extent permitted by law, NJ Houses for Cash and its owners, employees and agents are not liable for any indirect, incidental, special or consequential damages arising from your use of, or inability to use, the Site. Nothing in these Terms limits any right you have, or any liability we have, that cannot be waived or limited under New Jersey law or other applicable law.

Arbitration and class-action waiver

Please read this section carefully. It affects your legal rights.

Let's try to work it out first. If you have a dispute with us, please email us at info@njhousesforcash.com or write to us at the address below with your name, contact details, a description of the problem and what you would like us to do. We'll try to resolve it informally within 60 days. We'll do the same if we have a dispute with you. Neither of us will start an arbitration until that 60-day period has passed.

Binding individual arbitration. If we can't resolve it informally, you and we agree that any dispute, claim or controversy arising out of or relating to these Terms, the Site, any offer or estimate we give you, or our communications with you, including calls and text messages (a "Dispute"), will be resolved by final and binding arbitration instead of in court. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules in effect at the time, available at www.adr.org. It may be held by phone or video, in Hudson County, New Jersey, or in the county where you live if the rules require it. Payment of filing, administration and arbitrator fees will be governed by the AAA's rules. The arbitrator may award the same individual relief a court could award, and judgment on the award may be entered in any court with jurisdiction. The Federal Arbitration Act governs this section.

Exceptions. Either of us may instead bring an individual claim in small-claims court if it qualifies there. Either of us may ask a court for an order to stop the misuse of the Site or of our content. Any Dispute under a written purchase agreement signed by both of us is governed by the dispute-resolution terms of that agreement.

Class-action and jury trial waiver. You and we agree that each of us may bring claims against the other only in our individual capacity, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may not combine more than one person's claims or preside over any class or representative proceeding. You and we each give up the right to a trial by jury. If this class-action waiver is found unenforceable for a particular claim, that claim alone will be decided by a court, not in arbitration, and the rest of this section will still apply.

You can opt out. You may opt out of this arbitration agreement within 30 days after you first agree to these Terms by emailing info@njhousesforcash.com with your name, the property address (if any) and a clear statement that you opt out of arbitration. Opting out will not affect any other part of these Terms.

Governing law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules, except that the Federal Arbitration Act governs the arbitration section above. Any Dispute that is not arbitrated, including if you opted out, will be brought in the state courts located in Hudson County, New Jersey, or the United States District Court for the District of New Jersey, and you agree to the jurisdiction of those courts.

Changes to these Terms

We may update these Terms from time to time. When we do, we'll change the "Last updated" date above. Your continued use of the Site after changes are posted means you accept the updated Terms. A change to the arbitration section will not apply to a Dispute you or we had already told the other about before the change was posted.
